The pre-C2 wording of "evidence to the contrary" was changed by Bill C-2 to "evidence tending to show all" 3 things, 2 of which were next to impossible to prove. See R. v. St-Onge Lamoureux where the SCC held that the C-2 presumption section violated 11d but thing one was saved by Charter section 1, things 2 and 3 were not saved constitutionally by Charter section 1.
