If you are stopped by police or are invited or brought to a police station you should
be aware that the police will probably want to ask you questions. You should be very
careful about answering police questions orally or in writing or on video.

The offences of impaired driving and over 80, also described as impaired operation of a
motor vehicle and excess blood alcohol, require the assistance of a lawyer. There are many
technical
defences to drunk driving related charges.
If you are convicted of one of these offences in Ontario, your driver's licence will be
suspended for at least one year and you will frequently be prohibited
by the judge from driving for one year. That may have a significant impact on your
livelihood. A second conviction means at
least 14 days in jail.
Sometimes persons of otherwise impeccable character steal
something once during their life, especially at a time of emotional or financial stress.
If you are charged with shoplifting (theft
under), possession
of stolen property (goods from another store), or price tag switching (fraud
under), you should feel no shame in retaining the services of a lawyer to defend you.
If you are guilty, you may be eligible for a programme in Ontario known as
diversion or alternative measures.
Persons charged with shoplifting related offences who have no previous criminal record and
who have taken items of small value may be permitted to attend a special programme where
they listen to speakers, watch videos, and perhaps work in the community in exchange for a
stay or withdrawal of the criminal charge.
Assault
in Toronto or anywhere in Canada encompasses any intentional application of force to another person, including a
gesture. If done in self-defence
the act is not an offence (as long as the degree of force used is not unreasonable).
Sometimes consent is also a defence. Assault
causing bodily harm and assault with a weapon are much more serious.
If you are charged with a minor assault in Toronto your lawyer may wish to explore the
possibility of a common law or s.
810 peace bond. A peace bond does not result in a criminal record of a finding of
guilt or conviction unless you breach
the peace bond.
Domestic violence is totally unacceptable in the Greater Toronto Area and
anywhere in Canada. A person who has allegedly assaulted
his or her spouse can expect to be arrested, held overnight in jail, and brought to court the
following working day in custody for a bail
hearing. The person will find it difficult to obtain release unless he or
she can demonstrate a
stable alternative address, arrange for a relative (not his or her spouse) or friend to be a
surety,
and undertake to obey certain rigorous conditions including non-association with the
spouse and non-attendance at his or her former home. Relatives should immediately
retain both Toronto area criminal law and family law counsel (i.e. a lawyer). The spouse who is the
alleged victim should also immediately obtain counsel.
There is a difference in Canada between a finding of guilt and a conviction. Once a
person is found guilty of some
offences the Court must decide whether or not it will enter a conviction. In such a
case if the Court considers that it is in the best interests of the accused and not
contrary to the public interest, the Court may refrain from entering a conviction and
instead grant an absolute or conditional discharge. Although they have been found
guilty, persons who receive absolute or conditional discharges may truthfully say that
they have not been convicted. There are, however, records kept by the
R.C.M.P. and
the local police service of the absolute or conditional discharge. These records may be
used against you during a police investigation, during a bail hearing (depending on your
province), during a sentencing (depending on your province), and as a witness. About 1
year after sentencing you should consult a lawyer to determine whether such use is still
permitted or is prohibited under the Criminal Records Act.
A request should be made to the R.C.M.P. and the local police to confirm that they have
purged their records.
The words dui laws, DUI law, D.U.I, and "driving under the influence", are used
by DUI lawyers and DUI attorneys in United
States DUI Law. The expression "DUI" is not found in the Criminal
Code of Canada. Canadians use terminology other than DUI or "driving under
the influence". We use the words "impaired driving" or
"impaired operation", or "impaired care or control" but not "driving under the influence"
or "driving under impairment". In Canada it is any impairment by
alcohol or a drug of one's ability to operate a motor vehicle combined with
operation that is forbidden, not "driving under impairment" or
"driving under the influence" (DUI). It is also a "DUI"
criminal offence in Canada to drive having more than 80 milligrams of alcohol
per 100 mls of blood whether one's ability to drive is
"influenced" (DUI) or not .

It is NOT a criminal offence in Canada to drink and drive. Unless you are a
novice driver with a condition on your licence that requires a blood alcohol
concentration (BAC) of 000 mg/100mL it is not a provincial offence to drink and
drive. There may also be certain professional and statutory responsibilities for
particular professions such as pilots but it is NOT a criminal offence for a
member of the public to operate a motor vehicle after consuming an alcoholic
beverage.
The consumption of alcoholic beverages is lawful in Canada. Canadians produce
high quality liquor, beer, and wine. Our liquor, beer, and wine industries and
our restaurant, bar, and hospitality industries rely on the responsible
enjoyment of alcoholic beverages.
Canada is a big country with wide distances and necessary travel between our
homes, family, neighbours, and drinking establishments. We need our cars. Public transit is not
available everywhere. It is unreasonable to expect that a person who drinks
should not drive. It is often necessary to drive after drinking.
The real issue is responsibility in drinking and driving, not prohibition of
drinking and driving. Every drinker who drives should learn to measure and
remember the time, volume and alcohol content of every drink. If you know
exactly what you drank then you can calculate when you can drive. If for example
you know that each standard drink (and this varies from one individual to
another) constitutes 28 mg/100 ml of Blood Alcohol Concentration, then you know
that 3 standard drinks constitutes 84 mg/100 ml of BAC. Your body will eliminate
that BAC through the liver at a rate of 10 to 20 mg/100 ml for each hour since
you started drinking. If the person who drank 3 standard drinks had a total of
84 mg/100 ml in his or her system total and he or she waited 4 hours after the
first drink before driving, then 40 to 80 mg/100 ml was eliminated leaving 4 to
44 mg/100 ml BAC at the time of driving. 4 mg/100 ml isn't going to have
much effect, but 44 mg/100 ml is getting awfully close to the level of 50 mg/100
ml at which some jurisdictions suspend licences. Real responsibility in drinking
and driving requires that bartenders, hosts, and individuals serve known drinks
in measured and marked drinking cups, bottles, and glasses. Real
responsibility in drinking and driving requires that drinkers remember or record
exactly when and what they drank. Real responsibility in drink and driving
requires that governments, M.A.D.D., and police help educate drinking drivers
about how to calculate their actual individual BAC equivalent for each standard
drink as well their individual elimination rate. Ultimately, hosts of parties,
restaurant servers, and bar owners need to be held responsible for consistently
and accurately measuring, identifying, and recording what they serve every
drinking driver. Bar pint glasses and wine glasses should always contain a label
with their exact volume. Wine should be produced and served in individual
portions. Wine glasses and beer glasses should not be replenished from a shared
bottle or pitcher without a conscious decision by the drinking driver to accept
another glass . Menus should accurately describe the quantities served.
Restaurant receipts should accurately identify what was served, when, and to
whom. Failure of licensed establishments to comply should result in prosecutions
under the applicable Liquor Licence Act.
The expressions "DWI" and
"DUI" are not found in the Criminal
Code of Canada. Canadians use terminology such as "impaired driving",
"impaired operation", or "impaired care or control" rather
than than "DWI " or "driving
while intoxicated". We use the words "impaired driving laws" or
"impaired operation laws", or "impaired care or control laws" but not "driving
while intoxicated laws". In Canadian law it is any impairment by
alcohol or a drug of one's ability to operate a motor vehicle combined with
operation that is forbidden, not "driving while intoxicated".
The words "drive while intoxicated" in Canada implies that an
individual is drunk beyond the point of self-control. Provincial legislation
authorizes the arrest of intoxicated persons when there is an element of danger
to themselves. Intoxication may be a defence to serious criminal offences where
the drunkenness directly interferes with the individual's capacity to intend to
do something. When it comes to impaired driving law law in Canada we don't use the words
"drive while intoxicated" or D.W.I, DWI. Instead we focus on whether
or not the person's ability to operate the motor vehicle is "impaired"
by alcohol.
