See 21 M.V.R. (2d) 93. The concept is defined in section 2 of the Criminal Code as:

"motor vehicle" means a vehicle that is drawn, propelled or driven by any means other than muscular power, but does not include railway equipment;

The section contemplates a kind of vehicle, not whether it will function (R. v. Saunders), empty gas tank is irrelevant.
